This privacy policy (“Privacy Policy”) describes the practices of Sextant Real Estate, LLC (“Sextant Real Estate” or “we” or “Company” or “us”) for collecting, storing, using, disclosing, and protecting information. This policy applies to information we collect:

If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using this Site, you agree to the use of your information in accordance with this Privacy Policy.   1. Information We Collect

    The following generally describes the type of information we may collect about you.

    Information Provided by You. We collect information directly provided by you (which may be obtained from emails, as part of registration, web forms or in other manners), including, without limitation, the following:

    * Contact information, such as first name, last name, telephone number, and email address,

    * Personal identification information, such as contact information and geolocation; and

    * Account information, such as email, password and portrait image.

    This includes information provided at the time of registering for an account on our website, subscribing to our newsletters, or connecting with a listing agent. We may also ask you for information when you report a problem with our website.

    Should you voluntarily provide us with personally identifiable information, you consent to our use of it in accordance with this Privacy Policy. Content you Share through Chat. You may provide us with information and materials through our chat functionality that will be shared with other users. If you provide any information through such functionality, you acknowledge and agree that you are requesting us to make the information available to the other user.

    General Browsing. As you navigate through and interact with our Site, we use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

    * Details of your visits to our Site, including the content you view, the date and time that you viewed the content, location data, referring URLs, search terms, other communication data, and the resources that you use to access and use our website.

    * Information about your computer/mobile device and internet connection, including your IP address, operating system, and browser type; network carrier and country code; device ID and/or Ad ID; and browsing information, such as how you interact with the Site.

    Even if you do not submit personal information through the website, we gather navigational information about where visitors go on the website and information about the technical efficiencies of our website and services (i.e., time to connect to the website, time to download pages, etc.). This information allows us to see which areas of our website are most visited and helps us better understand the user experience. In this process of gathering information, we may collect personally identifiable and non-personally identifiable information (e.g., domain type, browser type and version, service provider and IP address, referring/exit pages, operating system, date/time stamp, and click-stream data). This helps us to improve our website and to deliver a better and more personalized service, including by enabling us to:

    * Improve the quality of the website by recognizing and delivering more of the features, areas, and services our visitors prefer.

    * Estimate our audience size and usage patterns.

    * Store information about your preferences, allowing us to customize our Site according to your individual interests.

    We may also create and use this navigational information to compile statistics about how our visitors collectively interact with our website. We may also maintain this information or associate it with personal information we collect in other ways or receive from third parties.

    User Preferences. We may collect information related to your selected preferences in order to provide you with recommended listings that are personalized and uniquely curated based on the preferences you selected. These preferences include: transaction intent (rent, buy, etc.), preferred locations, budget, home preferences, school preferences, and estimated closing date.

    Website User Activity. We may collect information related to your activity on our Site to suggest suitable homes to you based on your activities and behavior. Activities may include your interactions with various features on our Site, such as: viewing pages, adding a home tour, adding an open house, adding an item to your collection, adding a note, adding to inspiration, or when you compare, share, like or indicate you are not interested in a listing on our Site.

    Social Media. We may monitor social media or review sites, and collect information posted on comments or reviews. When you post information on social media pages owned or controlled by us, we may collect information about your activities on those pages, including whether you visited or commented on the page, or provided a rating or review.

    Generative Artificial Intelligence. Certain features on our Site allow you to submit questions to, or otherwise interact with, generative artificial intelligence (the “Gen AI Features”). Given the complexity of machine learning, use of the Gen AI Features may, in some situations, produce inaccurate or fabricated results. When you use these features, you understand and agree: you should not rely on results these features produce as a sole source of truth or factual information, or as a substitute for professional advice, and that you independently evaluate the results to confirm their accuracy. Further, you acknowledge that any such feature does not have the power to contractually bind Sextant Real Estate.

     

  2. How We Collect Your Information

    We collect information in three primary ways:

    1. You Give Us Information: We collect information from you when you submit it to us through our Site or other digital media.
       
    2. We Collect Information Automatically: We automatically collect certain types of information when you visit our Site. For example, we automatically collect various types of technical information when you use our website (e.g., your interactions with certain listings or photos) as otherwise described in this Privacy Policy.
       
    3. We Collect Information from Other Sources: We may obtain information about you from outside sources. For example, we may obtain commercially available information about you from third parties, such as public demographic information. We may also receive information from third parties who provide services for us through web-beacons and other technologies as otherwise discussed in this Privacy Policy.
       

    We also may use various technologies to collect information about you, including:

    1. “Do Not Track” Signals. Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked. At present, we do not respond to “Do Not Track” signals and consequently, will continue to collect information about you even if your browser’s “Do Not Track” feature is activated.     2. Use of Cookies. Cookies are bits of electronic information that may be transferred to a visitor’s computer or mobile device to identify specific information about the visitor’s use of the website, email or other electronic media. The website uses cookies, which assign a unique identifier to your computer. Cookies are typically stored on your computer’s hard drive and are used to help track clicks as you go through the pages within our Site. We may also use cookies to tell us whether you have previously visited the website. We also use cookies which may be set by third parties with whom we have entered into agreements which may enable us to obtain analytics information about the use of our website. You can set your browser not to accept cookies or to notify you when you are sent a cookie, giving you the opportunity to decide whether or not to accept it. You may also use commonly available tools in your browser to remove cookies which may have been placed onto your computer. However, please be aware that the website requires cookies to operate correctly. Other than as provided herein, we will not use shared local objects (commonly referred to as “FLASH cookies”) unless you are specifically notified that we intend to use them for a specific service. FLASH cookies are cookies that are placed on your computer that are not removed through normal browser management tools.
       
    3. Use of Web Beacons, Clear-GIFs, Pixel Tags and JavaScript. We may use “pixel tags” (also called “action pixels,” “web beacons” or “clear GIFs”) and/or JavaScript plug-ins, placed on our website and in our emails to you. Both pixel tags, which are small graphic images (typically that you cannot see), and JavaScript plug-ins, which is code on a website or in an email message, are used for such things as recording web pages and advertisements clicked-on by a user, or for tracking the performance of email marketing campaigns. These devices help us analyze our customers’ online behavior and measure the effectiveness of our website and our marketing. We also work with third party service providers that help us track, collect, and analyze this information. Third party entities with whom we have agreements may place these devices on the website and/or in emails to use information obtained from them such as pages viewed, emails opened and items upon which you may click in emails. These third party providers may also place cookies onto your computer. Those third party cookies enable us to obtain aggregated information (i.e., information where your personal information has been removed) and user statistics about you and your preferences.
       
    4. Server Logs and Widgets. A web “server log” is a record of activity created by a computer that delivers certain web pages to your browser. Certain activities that you perform on our Site may record information in server logs. The server log may record the search term(s), or the link you clicked on to bring you to our website. The server log may also record information about your browser, such as your IP address and the cookies set on your browser. A “widget” is generally an application that can be embedded in a webpage.

      Widgets can provide real-time information to the webpage. Widgets are often provided by third parties and we may provide widgets on our Site. Widgets may enable the third parties that provide them to collect data about users visiting the website.
       

    5. Search Queries on Our Website. We may provide you with options to search for information on our website. If you enter information in a search query box, we may store that information and we may aggregate that information with other information we may have about the browser and/or IP address from which the search query originated.
       
    6. Surveys, Contests and Promotions. From time to time, we may request information from users via surveys, contests and other promotions. Participation in these surveys, contests or promotions is completely voluntary and the user therefore has a choice whether or not to disclose this information. If you choose to participate, we may ask you for additional information, which may include contact information (such as name, email and shipping address) and/or demographic information (such as postal code, age level), to provide better services and options to you. We use the information you provide to administer our contests, sweepstakes and other promotions, in addition to the purposes set forth herein. If your information gathered via a survey will be used in a manner different from that described in this Privacy Policy, such use will be detailed in the survey instructions. For example, the instructions will alert you if the information will be shared with anyone in addition to those identified in this Privacy Policy, such as a third party sponsoring the survey.
       

     

  3. How We Use Your Information

    We use the information we collect in a variety of ways. We collect information from you because it helps us to provide, improve and deliver our products and services. Specifically, we use the information we collect:

    1. To Provide our Services. For many business purposes, such as to: (i) provide you with recommended listings; (ii) keep listing agents informed to help ensure appropriate actions are taken on their behalf; (iii) maintain client and agent information for future use within the system, including for example for use on the profile page, clients page, and agent floating buttons; (iv) generate a personalized collection when inviting a client and keep them informed about recommended homes that match their preferences; (v) recommend homes within the client’s budget; (vi) recommend homes that match the client’s preferred home types and styles; (vii) recommend homes that match with client’s school preferences within the specified areas; (viii) help agents remember the closing date for deals with specific clients; (ix) suggest suitable homes to clients based on their activities and behavior; (x) analyze trends and conduct research about improving our products and services; (xi) provide support and respond to questions from clients and website visitors; (xii) improve our website and services; (xiii) learn about customers’ needs; (xiv) contact consumers for research, informational, and marketing purposes, including customizing our listing recommendations to you based upon your information; (xv) support you in fulfilling your real estate transactions and objectives; and (xvi) track traffic patterns and website usage. When permitted by law, we may also use your personally identifiable information to contact you in ways other than email or regular mail, such as via telephone contact, facsimile or text message.
       
    2. To Market to You. To send you promotional, advertising and other marketing materials or communications from us or our agents, and provide you with more relevant advertisements (referred to as “Retargeting”). We may correlate your information with other commercially available information to identify demographics and preferences to assist us in our marketing efforts; and provide specific relevant marketing, promotional, or other information to you.
       
    3. To Improve our Business. To help us design and deliver our Site, including but not limited to as part of our network’s functionality, engineering activities, and troubleshooting.
       
    4. As part of Business Transfers. In the event that we: (i) are subject to negotiations for the sale of our business or part thereof to a third party; (ii) are sold to a third party; or (iii) undergo a re-organization, we may need to transfer some or all of your information to the relevant third party (or its advisors) as part of any due diligence process for the purpose of analyzing any proposed sale or re-organization. We may also need to transfer your information to that re-organized entity or third party after the sale or reorganization for them to use for the same purposes as set out in this policy.

      If we, or substantially all of our assets, were acquired, or in the unlikely event that we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer may continue to use your personal information in accordance with this Privacy Policy.
       

    5. To Comply with the Law and Our Legal Obligations. To investigate claims and/or legal actions, violations of law or agreements, and as part of complying with relevant applicable laws and legal process. For example, we may disclose your information in order to comply with or respond to a request or requirement pursuant to law or regulation, or from a governmental or judicial body, or to help prevent fraud or for risk management purposes.
       
    6. To Protect Ourselves and Our Users. To the extent necessary to detect, block, report and mitigate cyber-threats, improve our network and information security, and in order to prevent or detect fraud. Network and information security means the ability of a network or of an information system to resist events, attacks or unlawful or malicious actions that could compromise the availability, authenticity, integrity and confidentiality of stored or transmitted data, or the security of the related services offered by, or accessible via those networks and systems.
       
    7. We may use your information to cooperate with police and other governmental authorities, or to protect the rights, property or safety of visitors to the website or the public.
       
    8. When We De-Identify or Aggregate Information. We may collect, use, transfer, and disclose information that is de-identified or does not identify you. To the extent we combine information that is de-identified or does not identify you with information that does identify you that we collected directly from you on the Site, we will treat the combined information in accordance with the practices described under this Privacy Policy.
       
  4. Children’s Information

    We recognize the importance of children’s safety and privacy. The website is not designed to attract children, and is not directed at, or intended for use by, children under the age of 13. In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we do not request or collect any personally identifiable information (“PII”) from anyone who we know to be under the age of 13. If you are under the age of 13, you should not register with, or provide information to or from, us. If we become aware that a user of our website is under the age of 13 and has provided an online registration or other PII without prior verifiable parental consent, we will take all commercially reasonable steps to delete such information from our files and not to use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). We ask all parents and legal guardians to assist us in our efforts to comply with COPPA by prohibiting children under the age of 13 from providing us with any of their PII. If you have knowledge or become aware that a child under the age of 13 has submitted PII to us, please contact us and we will remove that child’s PII from our files. If you are under the age of 18, you should use this website only with the involvement of a parent or legal guardian and should not submit any PII to us.

    We may disclose personally identifiable information and non-personally identifiable information externally to our affiliates, licensees and joint venture partners, as well as to other third party service providers who help us provide operational services for the website and our business. However, we require these service providers to use your information only for our benefit and in accordance with this Privacy Policy. These service providers include, but are not limited to:

    1. Email Marketing Services Providers. Business entities that provide email address management and communication contact services;
       
    2. Information Technology Service Providers. Network equipment and application management providers and hosting entities;
       
    3. Other Service Providers. With other service providers which may be involved in the other types of services and activities otherwise discussed in this Privacy Policy.
       

    We may also share personally identifiable information and non-personally identifiable information with selected third parties, who may use your information for reasons other than for our benefit, including: a. Legal and Investigator Service Providers. We may share your information with judicial, administrative, legal, financial and/or accounting providers, and related government entities and adverse parties. Some instances where this may occur, include, but are not limited to: if we are required to response to civil and/or criminal investigations, claims, or lawsuits, or if we are subject to judicial or administrative process (such as a subpoena) to release your information or to prosecute or defend legal actions, and as we believe is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. b. Business/Asset Purchasers. In the event that we: (i) are subject to negotiations for the sale of our business or part thereof to a third party; (ii) are sold to a third party; or (iii) undergo a re-organization, we may need to transfer some or all of your information to the relevant third party (or its advisors) as part of any due diligence process for the purpose of analyzing any proposed sale or re-organization.     1. Agents. “Agents” are people and other entities we contract with, including our independent contractor licensed real estate salespersons and brokers, that may offer or provide services to you. Please note that although Agents may elect to use Sextant Real Estate designated email addresses or marketing materials, Agents are independent contractors who are not employed or controlled by Sextant Real Estate, and Agents may use your information in accordance with their own privacy policies. This Privacy Policy does not govern your interaction with Agents outside of the Site, and such interactions will also be governed by other privacy terms, if any, of the websites or services through which you are interacting with those Agents. In order to effectively offer products and services to you consistent with the purposes identified in this Privacy Policy and support you in fulfilling your real estate objectives, we may pass along personal information submitted by you to one or more of our Agents or affiliates, who may use this information to contact you about our sales, leasing, financing and other services. Further, our Agents may also use tracking technologies on our Site to gather information about your activities on our Site. You can opt out of such tracking by our Agents at any time, see Your Choices Regarding Your Information (located below).

      We may also share your personal information with our partners and related companies in the real estate industry, including mortgage lenders, appraisers and real estate management companies, regarding any transaction or service that we think may be of interest to you.
       

    2. Owners and Sponsors. We may share your personal information with the owners and sponsors of listings on our Site if you are interested in a property. In addition, we may share your personal information with the owners and sponsors of other properties who may seek to sell or lease their properties through us.
       
    3. MLS Listings. When you list a property with us, and you want to publicly market it, it is often required that the listing be disclosed with the Multiple Listing Service(s) (the “MLS”), enabling it to be visible to other real estate agents. The MLS, in turn, typically shares those listings with real estate companies such as Zillow or Redfin, or other independent brokerages, who may also display that listing on their respective websites. Our Agents must adhere to MLS listing requirements, and therefore, as part of providing you with the services; you cannot opt out of this type of information sharing.
       
    4. Google Maps. We use Google Maps on our Site to provide you with locations of property listings.     Third parties may also use various forms of technology through our Site to collect personally identifiable information and non-personally identifiable information. In these instances, your information is governed by that third party’s privacy policy. By using our Site, you agree to your information being collected and used in this manner. These technologies may include:

    1. Third-Party Use of Cookies and Other Tracking Technologies. Some content or applications on the website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not have complete control over these third parties’ tracking technologies or how they use the information they collect from you, but when we utilize any such service, we provide you with the option to opt-out of the further collection of your information by these services through our cookie banner.       • Meta Pixel. Third parties, including Meta, may use cookies, web beacons, and other storage technologies to collect or receive information from our Site and elsewhere on the Internet and use that information to provide measurement services, and to target and deliver ads.

        You can opt out or limit Meta’s collection and use of information for ad targeting by modifying your preferences and privacy settings on Meta’s platform.       • Google Analytics. We use Google Analytics to analyze how users interact with our Site. Google Analytics collects your IP address and places cookies on your computer when you visit the Site, which cookies are used to collect usage statistics, evaluate your use of the Site, compile reports on Site activity, and provide other services relating to website activity and internet usage.       • HotJar. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.   5. Links to Third Party Websites.

    For your convenience, our Site may contain links to other websites. We are not responsible for the privacy practices, advertising, products, or the content of such other websites. None of the links should be deemed to imply that we endorse or have any affiliation with the third party websites being linked to. Social Media Platforms. Our Site may include social media plugins and widgets that allow you to interact with social media directly through our Site, such as an Instagram feed. These plugins are provided by the social media company who may use them to collect various types of information, such as your IP address and which page you are visiting on our website, and they may also place cookies on your machine. The information collected by these plugins is governed by the privacy policy of the company that provides them.     We maintain presences on social media platforms, including Facebook, LinkedIn and Instagram. Our Site may include links that allow you to navigate directly to our social media platform pages. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. If you post any information on social media, it will be deemed public information and available to the general public. If you do post personally identifiable information, you do so at your own risk. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those platforms are governed by the privacy policies of the companies that provide them.   6. Your Choices Regarding Your Information

    If you do not consent to the way in which we may use your personal information, please do not submit any personal information to us. Opt-Out of Email Promotions. If you do not wish to receive emails about special offers and other promotions from us, click the unsubscribe link located in our emails.

    Updating Your Information. We prefer to keep your personal information accurate and up-to-date. If you would like to change your contact information, please contact Sextant Real Estate at [email protected].

    You may also contact us, as provided below, to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

    Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. We may retain your information in accordance with our data retention policies and for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements, or until you request us to stop using it. We may, however, keep some of your personal information to ensure that we comply with your request not to use your personal information or comply with your right to erasure. For example, we must keep your request to be erased, even if it includes your personal data, until such time as you are no longer our customer.

However, we do provide your information to various Agents as part of providing the services that you request from us, and to support you in fulfilling your real estate objectives. “Agents” are people and other entities we contract with, including our independent contractor licensed real estate salespersons and brokers, that may offer or provide services to you. 10. Your Rights and Choices:

10.1. Right to Confirm Processing:

You have the right to request that we disclose whether we process, or have processed, information about you. Once we receive and confirm your verifiable consumer request (see How to Exercise Your Rights, see below), we will disclose to you whether we are currently processing or have processed your personal information.

10.2. Access to Specific Information and Data Portability Rights:

You have the right to request that we disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable consumer request (see How to Exercise Your Rights, see below), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting, selling or sharing that personal information.
  • The categories of third parties to whom we disclose personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

     

10.3. Right to Correct Inaccuracies:

You have the right to request that we correct inaccuracies in personal information we maintain about you, with certain exceptions. Once we receive and confirm your verifiable consumer request (see How to Exercise Your Rights, see below), we will review your request to correct the information and upon verifying the inaccuracy of the personal information in our possession, we will revise our records to reflect the corrected personal information.

10.4. Deletion Request Rights:

You have the right to request that we delete any of your personal information that we collected from, or about you, and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see How to Exercise Your Rights, see below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

11. HOW TO EXERCISE YOUR RIGHTS: TO EXERCISE THE RIGHTS DESCRIBED ABOVE, PLEASE SUBMIT A VERIFIABLE CONSUMER REQUEST TO US BY EITHER:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.

12. Verifiable Consumer Requests by Individuals

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
  • Name, contact information, Social Security or individual taxpayer identification number, and date of birth; and
  • A copy of a government-issued photo ID. We accept your driver’s license, state ID, or matricula card.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Verifiable Consumer Requests by Authorized Agents

You may authorize an agent to make a request on your behalf. An authorized agent may make a request on behalf of an individual by using the submission methods listed above under this “Exercising Your Rights” Section. As part of our verification process, we may request that you provide, as applicable:

  • For an individual (“requestor”) making a request on behalf of an individual:
    • The requestor’s name; contact information; Social Security or individual taxpayer identification number; date of birth; and driver’s license, state ID, or matricula card.
    • The name; contact information; Social Security or individual taxpayer identification number; date of birth; and driver’s license, state ID, or matricula card of the individual on whose behalf the request is being made.
    • A document to confirm that the requestor is authorized to make the request. We may accept, as applicable, a signed permission by the individual on whose behalf the request is made, a copy of a power of attorney, legal guardianship or conservatorship order, or a birth certificate of a minor if the requestor is the custodial parent.

     

  • For a company or organization (“legal entity requestor”) making a request on behalf of an individual:
    • Proof that the individual has authorized the legal entity requestor to make the request. We may accept as applicable, a signed permission by the individual on whose behalf the request is made, copy of power of attorney, or legal guardianship or conservatorship order.
    • The name; contact information; Social Security or individual taxpayer identification number; date of birth; and driver’s license, state ID, or matricula card of the individual on whose behalf the request is being made. From the individual who is acting on behalf of the legal entity requestor, proof that the individual is authorized by the legal entity requestor to make the request. We accept a letter on the legal entity requestor’s letterhead, signed by an officer of the organization.

     

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

14. Response Timing and Format:

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to forty-five (45) days), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

15. APPEALING A PRIVACY RIGHTS REQUEST DECISION:

YOU MAY BE ABLE TO APPEAL A DECISION WE HAVE MADE IN CONNECTION WITH YOUR PRIVACY RIGHTS REQUEST. ALL APPEAL REQUESTS SHOULD BE EMAILED TO [email protected]. If we deny your appeal, you may be able to submit a complaint to your State’s Attorney General’s office through their website.

16. Universal Opt-Out Signals and the Global Privacy Control:

Our website has been configured to respond to global privacy control (the “GPC”) signals, and other such universal opt-out signals (each an “Opt-Out Signal”). When we detect that your browser is communicating an Opt-Out Signal, we will process that as a request to opt that particular browser and device out of sales and sharing of your information for targeted advertising through our website (i.e., via cookies and tracking tools).
